Sample cases include:

  • $2.2+ million dollar settlement. The claimant, a landscaper, was unfortunately rendered a paraplegic when he fell to the ground while trimming tall trees. The bucket that he was in fell from the supporting arm and the claimant suffered severe spinal cord injuries. The case was litigated for several years prior to settlement. Litigated benefits included provision of 24 hour per day professional attendant care services, home modifications, an electric wheelchair and provision of a handicapped accessible van.
  • $1.2+ million dollar settlement. Claimant was an office manager and suffered severe injuries when she slipped and fell on a hard tile floor. She suffered a traumatic brain injury as well as orthopedic injuries to her shoulder, back and knee. Litigated benefits included payment of permanent total disability benefits to the claimant, 24 hour per day supervision by a home health aide as well as provision of neurological and orthopedic care for the claimant’s extensive injuries.
  • $500,000.00 settlement. The claimant was a server at a restaurant when she slipped and fell on a wet floor. She suffered significant injuries to her lower back and wrist/hand. Litigated benefits included provision of a lumbar fusion surgery and treatment for complex regional pain syndrome for her wrist/hand injuries. The insurance carrier denied the claim for the lumbar fusion surgery on the grounds that the claimant’s need for the surgery was due to a pre-existing injury and prior surgery. The claim went to Final Hearing and the Judge ruled in favor of the claimant. The Judge ordered the insurance carrier to authorize the denied surgery. Claim settled after the claimant underwent lumber surgery paid for by the insurance carrier.
