Driver Accused of Causing Serious Injury while Driving Drunk
A South Florida man was brought before the judge in criminal court on Monday of this week to be charged with crimes including DUI and hit-and-run. The 31 year old driver had been arrested two days prior to his court appearance, when police officers found him sleeping in his vehicle only a few blocks away from the scene of the accident. The victim of the hit-and-run was a 45 year old man who was rushed to the hospital in critical condition, though it is not known what are the extent and nature of his injuries.
The driver who is being charged with drunk driving and leaving the scene of an accident was identified with the help of individuals who witnessed the pre-dawn accident. The witnesses were able to provide a description of the vehicle, which the police then used to locate the suspect. It can be assumed that the charge of DUI was based on evidence including a breath or blood test, as well as circumstantial evidence such as the fact that the driver was sleeping in his car. Unfortunately, a hit-and-run accident is also witnessed by nobody, including the victim who may not have been able to see the vehicle or the driver. In such cases it is often possible to find the perpetrator through the use of intersection cameras or nearby surveillance cameras. In cases where witnesses can describe the vehicle, law enforcement officers may look for automobiles with signs of having been in an accident similar to the one being investigated, such as dents or scraped paint. In some cases, the police may even offer a cash reward for tips which lead to the perpetrator.
Unfortunately for the victim in the recent hit-and-run accident, the fact that the driver has been arrested and charged with a crime does not guarantee that there will be any type of financial compensation for the injuries suffered. Even if the driver is convicted of the charges, it is still necessary to pursue legal action in a civil claim, whether for personal injury or wrongful death.
