Can I Go on Vacation While on Workers Comp?

Simply because you’re injured doesn’t mean you have to stop living your life. You should be able to get a living wage, have your medical bills paid, and even go on vacation. People are allowed to continue enjoying their lives as best they can even with an injury. However, those receiving workers’ comp who decide to go on vacation must consider this—if you perform activities on vacation that you are supposed to avoid based on a doctor’s recommendation, you risk losing your benefits.

Don’t Aggravate Your Injury

If you want to go on vacation, you must stay within certain restrictions, which requires smart and thorough planning. Even if you just plan to lay out on the beach, there may still be physical activities which could worsen your injury.

For example, if jet skiing is an option, you must be mindful that such an activity can aggravate a sprained back. Even standing up for a long period of time could compound an injury, so make sure to speak with your doctor or physical therapist beforehand. They could provide you with a home physical therapy program to do exercises in your hotel room so you don’t fall behind on their rehabilitation. Also, you should not miss or cancel any appointments with a doctor or physical therapist, just to go on vacation.

Be Careful What You Post Online

Insurers are known to do surveillance on people who file workers’ compensation claims, often by videotaping them. If you are observed or found doing things that you are claiming cannot be done because of the injury, then you may lose your benefits. You must also be very careful what you post online and on social media. Even if it only seems like you are participating in the restricted activity, but you aren’t, you can damage your workers’ comp claim. Employers sometimes monitor social media accounts of their employees, looking for workers’ comp fraud.

Remember, injured workers, like everyone else, should enjoy themselves to the best of their ability. You deserve a vacation, you just need to be careful that your fun in the sun isn’t misconstrued.
