One-Time Change in Treating Physicians
In Florida, injured workers are permitted to receive a one-time second opinion from a different physician. This is called a one-time change in treating physicians. However, there is a caveat with second opinions in that your employer’s insurance company can still choose the physician.
Submitting Your Request
You may request a second opinion from another doctor at any time during the course of your treatment. The request must be made in writing to your employer, who will then provide you with a list of qualified doctors. You can choose any doctor from the list, and your employer will pay for the consultation. However, if an employee elects to see a physician who is not on the employer’s list, the employee may be required to pay for the medical expenses out of pocket.
Independent Medical Examiner
When there is a dispute about the nature or extent of the employee’s injuries, the employer or insurance company will request that the employee is seen by an independent medical examiner (IME).
The purpose of an independent medical examiner in a workers’ compensation case is to provide an unbiased and impartial opinion regarding the nature and extent of the worker’s injury. The independent medical examiner is usually a physician who has not been previously involved in the workers’ compensation claim.
The independent medical examiner will review the worker’s medical records, interview the worker and any witnesses, and perform a physical examination. Once the examination is completed, the independent medical examiner will prepare a written report that includes their opinion on the cause of the injury, the expected prognosis, and any treatment recommendations.
