    Every personal injury case requires proving negligence by establishing the following four elements:

    1. The defendant owed the plaintiff a duty of care.
    2. The defendant breached that duty of care through an act of negligence.

If you’re 20% at fault, for example, and you have damages of $100,000, you’ll only recover $80,000.
